Sameday Health Subscription Membership Terms & Conditions
Your participation in the Sameday Health Membership (“Subscription”) is subject to these Subscription Membership Terms and Conditions (“Subscription Terms”). In agreeing to these Subscription Terms, you (“Member”) also acknowledge that you have read and agreed to Sameday’s Terms of Service and Privacy Policy. Participation in this Subscription is optional and is not required to receive health and wellness services from Sameday Health. By agreeing to these Subscription Terms, you acknowledge and understand that you can schedule health and wellness services any time outside of the Subscription Terms.
Participation in the Subscription as a Member is referred to herein as “Membership.” Details about the Subscription options available are provided here: https://app.samedayhealth.com/login, and by agreeing to these Subscription Terms, you acknowledge that you understand and have agreed to the Subscription offerings outlined to you in the client portal. You are responsible for periodically reviewing these Subscription Terms and for changes thereto, and by continuing your Membership, you hereby agree to such changes.
For all Subscription packages, the following terms apply:
1. Subscription Membership
Membership is for individual personal use only and not for any kind of business or entity. Only one (1) Membership account is permitted per person. Only one (1) account is permitted per email address. Only individuals who are eighteen (18) years of age or older can be Members. No Members may use their account for business or commercial purposes. Except as otherwise provided in these Subscription Terms, we will give you advance notice (which may be by email) of any material changes to your Subscription. Upon such notice you will then have the option to cancel your Subscription, but that will be the only option we provide to you, and you agree that this is sufficient. Substitutions of a Subscription service for an alternate Subscription service of the same or similar value, as determined by us in our sole discretion, shall not be considered a material change that requires advance notice to you.
For each Membership package, credits for various health services are available each month. Credits must be used within the month of the paid Subscription, and they will not roll over into subsequent months, with one exception as follows: Sameday Health will make every effort to accommodate your schedule so that you can use credits before they expire. In the event your scheduled subscribed service is cancelled or rescheduled by Sameday, and Sameday is unable to provide you with services before the credit expiration date, the credit for that particular service will be honored in the subsequent month.

2. Subscription Fees and Payments, Including Automatic Payments
The payment card you provide will be charged according to the prices published at the time you signed up for the services (“Subscription Fee”). The first payment will occur at the time you sign up for the Subscription, and your card will be automatically charged in subsequent months, in a frequency in accordance with the original Subscription term (e.g., every thirty (30) days), throughout the duration of your subscription. You will pay any and all applicable taxes, if any, relating to your purchase of the Subscription.
When you sign up for the Subscription, you expressly acknowledge and agree that: (a) Sameday and/or its third-party payment processor is authorized to charge the Subscription Fees to your payment method at the beginning of each subscription term, any applicable taxes and any other charges you may incur in connection with the Subscription for as long as your subscription continues; and (b) your subscription is continuous until you or Sameday cancels it. You acknowledge and agree that the amount billed may vary due to changes in the Subscription Fees and changes in applicable taxes, and you authorize us to charge your payment method for the changed amounts.
3. Payment Information
You must promptly edit all information to keep your payment method current, complete and accurate (such as a change in credit card number or expiration date) using the features and functionality of your account. You must promptly notify us or our payment processor and must change the information in your account if your payment method is canceled (e.g., for loss or theft) or if you become aware of a potential breach of security, such as the unauthorized disclosure or use of your username or password. If we are unable to process payment for your Subscription for any reason (including without limitation any inaccuracy in your payment information), we may suspend your Subscription until we can complete the transaction.
4. Subscription Communications
Members can opt out of emails that don’t relate specifically to the Subscription at any time, but as long as you are Member, you will continue to receive operational/transactional emails related to the Subscription.
5. Additional Subscription Terms
Subscription services cannot be exchanged or returned for any other product, service or monetary refund. We reserve the right to suspend or revoke your Membership if you are in violation these Subscription Terms or otherwise demonstrate conduct detrimental to our interests. If your Membership is revoked, any services associated with the Subscription will immediately expire unless Sameday communicates otherwise.
6. Cancellation
Members can pause their membership for sixty (60) days, once (1) per year.
Cancellation of subsequent months must occur before your next billing cycle. If you cancel your Subscription after paying the Subscription Fee, you will have access to all credits you paid for throughout the remainder of that Subscription month. Canceled memberships are subject to a thirty ($30) dollar reactivation.
